Can I Fight Domestic Violence Charges and Win?

Absolutely. It’s true that prosecutors are not always cooperative, and don’t like to drop domestic assault charges, even when the facts are weak. Police will arrest on on this charge based on incidents where no one was legitimately at risk, or injured at all. But they are trained and instructed to intervene in many types of heating arguments, especially if objects are thrown, even if not near the other person. You can get arrested for throwing a shoe, a wastebasket, or other light objects against a wall.

In these cases, the facts will usually win out, but it may take some legal wrangling to get there.

Why was I Arrested for Domestic Violence?

If the police are called to a domestic violence situation someone will be arrested. Wisconsin statute mandates the immediate arrest when any sort of crime has taken place in a domestic abuse situation. If you were the “primary aggressor” in the situation, you will be placed under arrest.

The police determine who the “primary aggressor” is by looking at the situation, any injuries, fear from either party, or history of domestic violence.

Why can’t I go home?

If you are released from jail following your arrest, a 72 hour no-contact order will be put in place. This will keep you from contacting the alleged victim and includes going into their residence, even if you live there too. If you violate this order, you will face another arrest and additional criminal charges.

After the 72 hours a restraining order may be put in place as well.

Why is it considered “domestic” when she isn’t my wife?

Domestic abuse does not only occur between spouses. Wisconsin law defines a domestic relationship as one between:

  • Spouses
  • Roommate
  • Ex-roommate
  • Ex-spouses
  • Someone with who you share a child

What kind of sentence will I face?

The charges you face depend on the circumstances of your case. Chances are you will be charged with a battery offense of some kind. Depending on the situation and the injuries inflicted, battery can get you up to 15 years in prison and fines up to $50,000.

In addition to serving time and paying fines, you may have to complete anger management courses and counseling.
